Please read these Terms and Conditions ("Terms") carefully before using the Clik mobile application ("App") provided by Clik Photos Inc. ("Clik"). These Terms govern your access to and use of the App. By using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not access the App.

Account Creation and User Responsibilities

1.1. In order to use certain features of the App, you may be required to create an account. You must provide accurate and complete information when creating your account and keep your login credentials confidential. You are solely responsible for all activities that occur under your account. 1.2. You agree to use the App in compliance all with applicable laws and regulations. You will not use the App for any illegal, harmful, or unauthorized purposes, and you will not engage in any activity that disrupts, interferes with, or harms the operation or security of the App.

Intellectual Property Rights

2.1. The App and its content, including but not limited to text, graphics, images, logos, and software, are the intellectual property of Clik Photos Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reproduce any part of the App without prior written consent from Clik Photos Inc. You do have the right to download, reproduce, and otherwise utilize photos you have been identified and/or tagged in.

User Content

3.1. By using the App, you may have the opportunity to submit, post, or share content, including but not limited to photos and comments ("User Content"). By submitting content, you grant Clik Photos Inc. a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your User Content for the purpose of operating, promoting, and improving the App.
3.2. You are solely responsible for the content you submit through the App. By submitting, you warrant that you own or have the necessary rights and permissions to grant the license in Section 3.1 and that your User Content does not violate any third-party rights or applicable laws.
3.3. Photo Sales: Clik Photos Inc., through the App, may offer digital photos and/or prints for sale to users. All sales of digital photos and/or prints are final, and there shall be no refunds once a purchase is completed. By making a purchase through the App, you agree that all sales are final and non-refundable.

Limitation of Liability

4.1. To the maximum extent permitted by law, Clik Photos Inc. and its officers, directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the App, even if advised of the possibility of such damages.

Governing Law and Jurisdiction

5.1. These Terms shall be governed by and construed in accordance with the laws of the State of New York. Any dispute arising out of or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.

Changes to the Terms

6.1. Clik Photos Inc. reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the App. Your continued use of the App after the posting of any changes constitutes your acceptance of the revised Terms.
